TikTok's ad revenue is crazy high - if it gets banned in the US, it's more likely an economic decision with a data security front/disguise. Banning it would bring a lot of money back to US companies like Facebook, Instagram, etc. and which would be very beneficial to the US GDP and economy. Everyone is collecting/selling data - it just depends on which country is making the money from the data. Just a thought

Hey Noel, I can actually speak to officers’ qualified immunity pretty well. I just graduated from law school and have worked a lot on civil rights cases related to officers’ excessive force. (Sorry, this is gonna be kind of long). So the Fourth Amendment protects against “unreasonable seizures” which has been interpreted to include excessive use of force in an arrest. So in theory you could sue individual officers for damages for excessive use of force. But about 40 years ago, the Supreme Court established this freestanding concept—not at all related to the Constitution—that police officers need some leeway because their job is dangerous; they don’t want people getting into officers’ pockets because of a relatively minor constitutional violation (not saying I agree with that, it’s just the Court's rationale). So they decided that individual officers should have “qualified immunity” from civil suits for money damages. They said that the law the officer violated has to be “clearly established” before an officer can be individually sued. And what “clearly established” means has been construed super narrowly on a factual level over the years. You basically need to point to another court case that has almost exactly the same facts as yours in order to show that the law was clearly established, it’s just a crazy demanding legal standard. If the facts of your case are different in any meaningful way from the case you're referencing, the law is said not to be clearly established and the officer is immune. Obviously that’s resulted in a lot of officers not being able to be sued. You can still sue an entire police department or even a whole city, but that can sometimes be harder to prove because you have to show some negligent training and stuff like that. So this Colorado law basically skirts around that concept a bit. From what I understand, the law isn’t at all related to the US Constitution, which is what most people sue under for excessive force cases. Here, you can sue in CO state court based entirely on this new law, and individual officers can be forced to pay money damages under the new law--there's no qualified immunity here. Qualified immunity still exists under the Fourth Amendment, but this new law provides a totally separate right of action in state court to basically fix the problem and provide for some heightened accountability on the part of officers. QI has been controversial and a huge issue for civil rights lawyers for decades, for so CO to do this is a pretty massive and unprecedented step.

Noel what you talked about in Colorado is called qualified immunity. Basically it allows for exemptions in certain legal situations depending on your employment (usually law enforcement). Abolishing qualified immunity is a great first step in ensuring police officers take the needed steps to not only go through proper procedures, but it will also help curb police brutality.
