Hey Curtis. The successful instances of Full Length that I've seen did not use Vimeo. They used Google Drive and MEGA (since Google Drive easily hits view and download limits) and then links them in a patreon post. (You don't have to download. Both GDrive and MEGA allow you to view videos through the website.) Vimeo might work, but if it doesn't Id recommend trying MEGA before giving up on it. ... In fact, I'd recommend using MEGA from the get-go. It's easier to view on mobile that vimeo, its faster and easier for you to upload, AND it gives people an easier way to watch offline.

I think One Piece really should be full reactions. I mean you watch the entire episodes anyway, so no lost time on your part. Less editing, slightly longer upload time. I doubt there will be any issues over this, not when it's on Patreon. The way you've been doing it does work, but at the same time there's reactions we miss because you skip scenes. I'd rather see it all.

The only real argument against fair use that would take it to court is that it is hurting the profits of the original creators. Not only does the western audience account the a extremely tiny portion of the profits these anime make, those who don't buy the official merchandise are people that are unlikely to buy it in the first place. We pay what we pay here for the reaction, not the anime, just interested in Curtis' opinion.

Lewd, I'm not saying that editing a vid down might not have an effect in a court case. My point is, if you throw out what people have said, over and over, with no impetus to have lied, then there is no case to be made no matter how they're edited. That IS the proof of the videos being transformative; that I can show where people are watching the reactions despite having full knowledge and experience with the series itself. All testimony is simply someone's "word"... And whether or not they watched it through legal means would have no bearing on my case. All I need to show is that they already had full knowledge of the show before watching my reaction vid. As a matter of fact, if people had watched the original illegally (for free) but are willing to pay to be a member here and watch my vid, that would, perversely enough, strengthen my claim of a transformation of the material.

If you go to the overview of the Patreon channel it states ‘Spaz Boys Comedy is CREATING VIDEOS’ not ‘Spaz Boys Comedy is DISTRIBUTING ANIME EPISODE’. The Patreon does not only specify to anime, anime does have a majority factor in the Patreon but its not the only content provided here.

Editing the episodes down to a specific time does keep it within fair use though. It is a valid defense. What proof would you have that any of the 2000 people here have legal copies of the shows watched and that they have watched them previously, other than their word? Their word that holds no real weight in court in case this comes down to a bad lawsuit

In fairness, Lewd, if being able to prove that viewers are here for the reaction (constituting the transformative nature) isn't enough to prove Fair Use, then we will most definitely lose either way. If that element is thrown out, just saying that editing out 9-10 minutes of the episode alone makes it Fair Use will never hold up.

While i would personally love to see the reactions fully here, i don't believe it worth the risk. Specifically for the reason that, while i do believe your edits are in fair use, a full length reaction could not be defended. Simply because of the fact that im pretty sure the 'people have seen this before and are here purely for the reaction, and i can prove it because they all said so on the internet' defense would not hold up in court, and since thats the main defense you'd have with doing full length reactions who knows where this would spiral towards

My biggest point of contention with that would be, in the case of the book, is there any evidence to suggest that the viewer/listener hadn't already read the book for themself and was now just listening/reading the review to get a new perspective? The crux of my claim to Fair Use - be it with or without edits - is that I can prove that the viewers A) have already seen the content that's being reacted to and B) are here strictly for the reaction... I'm not saying that guarantees me a win on the basis of Fair Use, as there is so much ambiguity in the doctrine, I'm just saying that in either case - edited or not - the defense doesn't really change at all.

Not gonna lie, i disagree with this. I do not consider this to fall within fair use. In much the same way, i would consider it fair use to critique part of a novel as part of a review of the book, but i would not if i were to reproduce the entire text as part of the review, with comments and footnotes sprinkled about. Even if Patreon doesnt object to it, and even if the company doesnt either... im honestly not very comfortable with the idea. Still, your content. Do what you feel is right... but i cant agree with it at this point.

Nah, music is a separate issue of Fair Use altogether. An individual video devoted just to an opening, with me giving my thoughts while it plays, would be way more likely than showing the opening during the reaction vid.

Of course, it bears noting, too, that it's REALLY not in the best interest of the Japanese companies to test me legally. If they win, I have to stop making reaction vids. If I win, the precedent has been set that this is, indeed, legal, and the doors will get blown off for more reaction vids.
