With both One Piece and Yu Yu Hakushu coming up soon, I'd like to get you guys' feedback, as we make decisions here as a community. It's a long read, but please take the time if you have a few minutes. I'll post both Brother E's post, as well as my response. We could also post a new poll about this, given this level of information, if you guys like. :-)
BROTHER E'S POST:
Hey Curtis, I always appreciate the hard work you do for us when you spend so many hours editing videos and just setting up content to provide for us. It makes me feel bad that you have to go through all that labor. I’ve seen plenty of Patreons similar to yours where the content is Anime Reactions. The only difference has been they show full length episodes as opposed to editing them like you do. I really would want you to consider starting Full Length Reactions as opposed to editing, not so for the content itself, but more so for you being able to do more things at your own leisure. Now I know you’ve always had a stigma about not going into full length videos but I think with the information I’m about to share with you may convince otherwise.
So I was doing a little research about how Patreon works with handling copyright issues and the DMCA. I see that Patreon is VERY lenient with what is considered Fair Use. It states that you can upload any copyrighted content onto Patreon as long as it’s not directly hurting the original content creators’ profit. Which in this channel’s case it doesn’t since people are paying to support you for making content rather than paying for each individual video.
Another piece of information I picked up on is that with anime in particular. The only people who have the rights to file any sort of copyright claim are the Japanese companies who originally owned the content. Now the good part about that is these Japanese companies are filing these claims that abide by ‘Japanese Copyright Laws’ which are more inclusive than American Copyright Law. From what I’ve understood with American Copyright Law is that you’re still within your fair use as long as you’ve had claimed to purchase/pay for any of the copyrighted material you’re providing on your platform and as well as the audience of people whose paying for YOUR content. Which they are since they pay behind the Patreon Only service that is setup in your channel. So by those standard alone since you provide content with the fair use laws in the country you reside in, which isn’t Japan, any copyright claim a Japanese company files should be nulled immediately.
Lastly Patreon says they support and trust content creators since they’ve been aware of the unfairness of YouTube & Other Companies that take advantage of the DMCA and their policies. So Patreon states they want to help Content Creators avoid any Copyright Claims and plus support the creators with protecting the rights of their content. Patreon is also doing its best to help users understand how to properly provide a counternotice but even going a step beyond that, pointing users to discounted legal support if they want a lawyer to review a counternotice:
“We also forward them the DMCA notice we received and specific instructions on how to send a counter-notice. Sending a counter-notice carries a lot of legal risk for creators, so we have partnered with attorneys who represent creators to offer a guaranteed flat rate of $350 for a counter-notice review to take some of the uncertainty out of the process. If you aren’t using an attorney, then counter-notice instructions can be confusing, so we’ve made every effort to simplify them.”
Unlike YouTube, Patreon does support Content Creators and the content they post up such as yourself. You got to appreciate Patreon for taking this step, though it really demonstrates (yet again) how out of step with reality the DMCA is today.
With all that given there shouldn’t be any reason of not transitioning into Full Length Reactions. The legal support system for doing it is there, the amount of time saved from editing on your part is abundant & the content provided to us is more. Doing such a transition into full length isn’t as risky as we originally thought. So hopefully reading through this and just picking up on some of the information I provided for you will make you have consideration into starting Full Length Reactions. Nevertheless at the end I enjoy your content and your work ethic.
MY RESPONSE:
Actually, My Friend, I'm aware of those things. The reason I've continued doing things the way I have is I believe cutting them up strengthens my Fair Use case. However, I agree with you that there is still a strong case to be made for full length still being covered, especially since everything we do here is behind a paywall.
I'll tell ya what, let me post what you wrote - plus my response - up at THE GOOSH, and let's get a feel for what everyone else thinks. :-)

I have known of two reactors that use full length: SuperMechaFrieza with One Piece, and AppsolutelyGeek'd with Naruto and Death Note. I don't think they've had any issues with them. In fact, SMF recently did a reaction to a One Piece opening with no editing and it's been just fine. HOWEVER, the opening was just done recently, and I think she has had some trouble with Bleach. Though, that may have only been on Youtube. I'm unclear on those details. I'll ask her when I get the chance. EDIT: Ok, yeah, she got back to me and said it only ever happened on YouTube. Never patreon.

Either way I pay this subscription cause I Love You and our community, you’re reactions and commentary it’s what I’m here for since I’ve already watched the shows on my own. No matter what you decide to do edited or not I’m here to stay so do what is most comfortable for you.

I have not heard of companies, especially anime companies, relentlessly going after somebody for fair use violations. The Japanese copyright laws are much tougher, but all they can do really is block the video in Japan– I'm not sure how many Japanese fans we have, but I'm sure it's not much. I'd put this to a poll if I were you.

On the other hand, when it comes to eventually uploading them to youtube, you can just not show the actual video and instead set up a timer on the screen to show which part of the episode you're on. I've seen many reactors do this. Furthermore, One piece episodes eventually will become shorter anyway because they start doing 5 minute recaps, so those videos will already be smaller from the start.

As I'm not a content creator myself I'm not familiar with the laws just a comment off of what was said above

I don´t know shit about fair use so im not gonna even try to advice you on that but showing full episodes sounds to good to be true. Anyway you do it is fine by me, just do whatever you´re most comfortable with big man! btw which show will One piece take over after?

2019-02-27 22:18:45 +0000 UTCWell Baldman...I Personally I think a risk is still a risk but then again every day the earth is at risk of being shattered by a random giant rock hurtling through the blackness of space But I also would love for you to have more free time if I had to make a suggestion id Say if the laws are more lenient then previously though I have to ideas one worse then the other you could edit while you watch by muting our sound every now and then or placing a black box over the video and quickly removing it when it looks like things might start to pick up....or you could just do that afterwards instead of cutting up just put an obstacle in our way every now and then it probably wont take as long as cutting it up but I guess it will still take a while...but im not sure I aint no expert....but everyone will get your entire reaction either way and really thats all that should matter to us Gooshers(but not over and above your own opinions and health and by that what I mean is) since we all should of already seen the anime your reacting too anyway whether we saw it a while ago or watch it a single episode in advance to catch your reactions wed immediately know what your laughing or recoiling at even if we cant see their faces but all that matters to me and all of us here is that you dont work yourself to death too...and I hope this helps even if only a little...

All of us here have already watched the anime you are reacting too and all we watch and love is too see your reaction to our favorite anime and make cringy jokes as well as always hearing the train and you cursing it. We love you curtis (yes homo) and we love your reactions and we woud love full length reactions and if it protects you as brother e investigated i say go for it. I can just imagine all the time it takes to edit three videos a day for almost a week, no a week because you upload on sunday the goosjer 100 videos. and all the time it takes away from you doing something else or spending time with your family or just enjoy life and all because of us. We love your dedication toward us but you still have your life to live not everything is the goosh. And if full lenght reactions will be better for you and take that load of your back i say go for it we will still support either way. Try ot out first and lets see where it takes us. Fingers crossed for full reactions thou imagine you guys 22-23 minutes video reactions all days god that would be so awesome but it's up to you fatman and thanks brother e for being such a dedicated goosher and searching all this up for curtis and us because its a win-win for both in curtis gets more free time and we get full lenght reactions.

But i think with almost all of us saw the animes u react to, i think the edited cut down version is better for us to watch, Its just an opinion. You can check later on what is better. Overall i think it will be great watching full length episodes with you Curtis.

Although I will say with the reaction videos you post now, I hardly ever notice any cuts (aside from intros and outros, which I don’t think anyone misses seeing in the first place). I don’t know if that’s on account of your editing skills, or you just really manage to pull me into the video with your hypnotist skills. Basically what I’m trying to say is, I would give it a shot, given what Brother E has shown you. But if you don’t go through with it, I don’t think people will miss much.

My feeling on that, though, is I think it wouldn't hurt our Fair Use claim any, as long as the comments and interactions still validate that all of you guys have already seen the original and only come here for the reaction. If that's the case, the reaction vids can honestly only serve to prop up the original more. :-)

He spends hours just editing these videos for us and it probably takes away time he’d like to use for other things. Such as spending time with his daughter, his sick mother, his wife, doing some more writing or even simply having a live stream more often. At the end we all are here to support Curtis. So why not support a cause that will take a bit of work load off his plate.

2019-02-27 21:56:13 +0000 UTCThe thing is, most people who upload full length reactions, don't include the original video or audio with it and have people sync it up on their end. So I'd be REALLY careful about this. You're also hosting the videos through Vimeo which means that you have to use their DMCA rules as well as Patreon's rules. The other aspect is that when you have to consider whether or not you want to give full reactions or edited ones when you redirect on YouTube for all the non-patrons. Lastly I do appreciate the time and effort you put into your reaction videos and I personally like them. Regardless, I think you should have full length as a separate option even if this idea doesn't work out; even if it's just the reaction (like I discussed before.)

My only concern might be with you doing full length on One Piece as that is still a currently airing show in Japan and even though it would still take you quite a while to get to anything even somewhat near the current episodes, the company might still throw a small fit. Yu Yu Hakushu has been aired and done for so long that there really isn’t a claim for you stealing profits from any company.

If one of the Japanese companies believes I'm violating their copyright, they can take me to court. At YouTube, they just file a block and, even if I'm in Fair Use, I have no recourse... I just have to decide if I feel that full length can be considered within Fair Use. I'm leaning towards yes it is.

Having to cut content some people don’t appreciate and it’s definitely tough on you deciding what to leave and cut out and sometimes you’ve cut out scenes that people wanted to see your reaction on. I would definitely approve to have you just post full length reactions it would save you time on editing too.
